Tuesday News Roundup: Arizona Shenanigans Show Why Trump is Fighting a Longshot Battle

Dear Joe DiGenova: You are not being helpful. – Why the President would entertain having Joe DiGenova as a part of his legal team in the election fraud fight is anyone’s guess. But it turned into a big fiasco during yesterday’s informal fact-finding hearing in Arizona. Jonathan Turley summed up my feelings on the matter pretty succinctly:

Not helpful, Joe. Not helpful at all. Go away.

As for the rest of that hearing, legislators in attendance heard tons of testimony from witnesses to the rampant election fraud efforts that went down in their state – especially in Maricopa County – on Election Day.  A parade of witnesses testified to abuse of the process by Democrat election officials and regarding the insecurities of the Dominion Systems machines and software in use in Arizona.

Unfortunately for the Trump effort, the only part of the hearing that got any traction with the corrupt news media was DiGenova’s idiotic outburst, so the hearing did little to advance the Trump cause. It’s important to note here that, like the hearing held last Friday in Pennsylvania, this was not a formal hearing called by the Speaker of the House or Senate President in Arizona, which would have been extraordinary given that the legislature there is not currently in session.

As a result, despite the promises given by the Republican members in attendance to seek a special session to reconsider the state’s process for choosing its electors, there is very little likelihood for that actually taking place, just as there is virtually zero chance that GOP legislators in Pennsylvania or any of the other states in question will summon the political will to act.

I have warned you all along that the courts are literally the President’s only chance at reversing these election results, and his court cases are long shots as well. That is not because his cause isn’t just – it clearly is – but because getting any legislature or court to act to do the right thing here requires an extraordinary act of political or judicial courage on their part.

The vast majority of GOP politicians and judges are cowards at heart. They talk a good game but seldom possess the courage to follow through in their official actions. There are 10 dozen Lamar Alexanders and Lisa Murkowskis in the GOP for every Ted Cruz or Rand Paul.

Any legislator or judge who acts to overturn these reported election results is going to come under withering assault from potentially violent leftist activists and the entirety of our corrupt media establishment. It is a rare politician or judge indeed who will be willing to invite such an assault on themselves and their family members by acting to do the right thing.

Instead, we are almost certain to see the public posturing by legislators we have seen thus far in PA, AZ and Michigan, but that will be followed by a decided lack of real action. Where the judiciary is concerned, the U.S. Supreme Court is really the only hope for the President and his supporters. We can be certain that John Roberts will timidly side with the three communist justices on the court, meaning that every one of the five conservative members would have to hold together in the face of the media/Democrat assault.

A new poll this week shows that 47% of Americans now believe – correctly – that this was a stolen election. But there remains very little good reason to be optimistic that any of the fraud will be reversed. That’s just  me dealing with reality, folks. You should all deal with it, too.

Here’s a great example of that sad reality. – Arizona Governor Mike Ducey, a nominal Republican, eagerly certified the state’s election results as the informal hearing was taking place, and promised to quickly swear-in Democrat Mark Kelley to take over the senate seat currently held by Republican Martha McSally, who Kelly supposedly defeated in the election. Because that’s the kind of thing fake Republicans like Ducey do.

Here’s an excerpt from a report at Mediaite, noting that Ducey apparently ignored a last minute call from the President himself while in the process of pandering to his Democrat masters:

Arizona Governor Doug Ducey received a phone call in the middle of a live broadcast of an election certifying ceremony that confirmed his state’s electors would vote for President-elect Joe Biden. Ducey blew off the phone call, which, judging by the ringtone and Gov. Ducey’s previous account, was a phone call directly from President Donald Trump.

That’s right. Trump appeared to make a last-ditch phone call to Gov. Ducey to keep him from certifying the election results, and the governor ignored the call. The most embarrassing part? It was captured on camera.

The moment was first noted by Arizona local news host Brahm Resnik, which the producers at Morning Joe cleverly cut with footage with Ducey’s prior admission that he had customized the ringtone on his phone to play Hail to the Chief every time President Trump rang him directly. As you can see and hear in the footage above, the incoming call’s ringtone is definitely Hail to the Chief.

Note to Arizona voters: When presented by your state GOP with limp-wristed RINO candidates like Doug Ducey, just vote for the Democrat instead. You will be less disgusted with the results of your actions.

Over in Georgia, the Secretary of State who keeps bragging about how “secure” his election was, Brad Raffensperger, admitted on Monday that his office is investigating no less than “250 cases of credible claims” of election fraud.

From a report at DailyWire:

“As we move forward in the process, we will, as we always have been, we will continue to investigate credible claims of illegal voting and violation of state election law,” Raffensperger said. “There are currently over 250 open cases from 2020 and we have 23 investigators to follow up on that. Some of these include, a charge Gwinnett County that absentee ballots outnumber absentee envelopes. This is the kind of specific charge that our office can investigate and ascertain the truth.”

“We have multiple investigations underway surrounding absentee ballots in Fulton, Gwinnett, Cobb, and many others. We continue our investigations into potential dead, double voters, and non-resident voters,” he continued. “As we move to the December 1st election, which is tomorrow, and the January 5th federal runoffs, we have to remain vigilant.”

“That is why I’m announcing an investigation into third party groups working to register people in other states to vote here in Georgia,” he added. “We have opened an investigation into a group called America Votes who is sending absentee ballot applications to people at addresses where they have not lived since 1994; Vote Forward, who attempted to register a dead Alabama voter, a woman, to vote here in Georgia; The New Georgia Project, who sent voter registration applications to New York City, at Operation New Voter Registration Georgia, who is telling college students in Georgia that they can change their residency to Georgia and then change it back after the election.”

Raffensperger concluded the press conference by repeatedly reminding people that committing election fraud in Georgia, which includes voting in the state when a person is not a resident of the state, is a felony.

Oh. So, maybe the election wasn’t all that “secure” after all, huh?

Be careful about this one, though: Anyone expecting Raffensperger and his investigators to really conduct good-faith investigations of all of these myriad claims of fraud should remember that this is the man who has steadfastly refused to conduct anything resembling a real audit of absentee and mail-in ballots in his state.

This guy is part of the problem, not a part of any solution.

Good to see CNN latching onto reality here. – While all of that was going on, the despicable news-fakers at CNN suddenly discovered what the rest of us have understood since February: That China has not exactly been up-front with the rest of the world where COVID-19 is concerned.

“This is Gonna be a Bang-Bang Couple of Weeks” – Joe diGenova

Today’s Campaign Update, Part II

In case you missed it, take 10 minutes out of your day to watch the clip below. – Laura Ingraham had Rudy Giuliani and Joe diGenova on together for a 9 minute segment Tuesday night, and both men were very blunt in their assessments of the sordid behavior of Nancy Pelosi and her House Circus Clown caucus, the status of the fake impeachment process, and of the Barr/Durham investigation, among several other topics.

Here’s the clip:

For those of you who still like to read stuff, here are some key quotes from Giuliani and diGenova:

Giuliani: “I would love to testify [before the House Intel Committee], give me a half hour to point out  ‘Biden inc.’. Four decades of crime. I’d love to do it.”

Giuliani: [After seeing clip of Cory Booker saying he’d love to question Giuliani if he testifies before Senate Judiciary Committee] “I have to go into the arena with Spartacus? Gee, I don’t know if I could handle it. I mean, he’s a really tough guy. I don’t know. Man, he really scares me.

“He was a terrible mayor. I was a mayor of a city [New York] and I turned it around. He was a mayor and the city [Newark] had more crime when he left than when he came in.”

diGenova: “This is why this notion that you are going to keep these witnesses identities secret, while they are trying to nullify an election, commit regicide, and remove a president of the United States is ludicrous. Everybody knows that in all likelihood, Fusion GPS was involved with this person, this ‘anonymous informant’ – I refuse to call him a whistleblower because he is not a whistleblower under the law – and everybody knows that there is a former FBI agent[!] who worked with this whistleblower, as he is now called.

“So, we’re going to learn a lot about the fact that this person never wrote this document, this was drafted by a committee of political consultants and researchers and people affiliated with the Democrat National Committee.

Giuliani: “Adam Schiff is a witness. You can’t preside over a hearing where you’re a witness. Also, how can it be possible that we can’t test the credibility of these witnesses? You can’t come to a conclusion unless you can test credibility. For example, this law firm – Campos, Dampos or whatever the name of it is – was offering money to people. They were offering help with your mortgage, expenses, they were bribing the witnesses to come forward. You don’t think I’d want to cross examine the witness with that?”

diGenova: “Here’s the deal. This [IC] Inspector General is a moron. When he wrote that analysis he was wrong about the law, this was not a ‘matter of grave concern,’ he got slapped down so badly by the office of legal counsel when they analyzed the facts. This guy, Michael Atkinson, is a moron. There is no way around how bad a job he did. He’s an embarrassment to the inspector general cadre.”

Giuliani: “I’d just like to explain to ‘little Schiff’ that propounding and presenting a false narrative of someone’s guilt is called obstructing justice. He did it. He did it right in front of the American people, he did it for about 20 minutes. And he did it again, earlier, when he said he had evidence of ‘Russia collusion’. Where’s your evidence, Schiff? You’re a liar – I’m calling you out as a liar. Where’s your evidence?”

diGenova: “If it weren’t for double standards, Democrats would have no standards at all. This is just insanity…that tape of Schiff, just watching him, bug-eyed, performing like a loon, and watching him pronounce these nostrums that are stupid and unsupportable legally, this is the chairman of a major committee, and Pelosi, you know, trying to keep her dentures in her mouth while she’s talking to him, is just there, abiding by this, it’s outrageous.”

Giuliani: “And it would be funny if it wasn’t such a horrible, horrible trashing of our constitution.”

diGenova: [Asked how confident he is that big things are coming from IG Horowitz’s report and the Barr/Durham investigation] “This is gonna be a bang-bang couple of weeks.”

Dear Nancy: Until you hold a vote, buzz off. Yours truly, Donald. –  News broke late Thursday that the White House will soon shoot a letter off to San Fran Nan and her band of merry munchkins, possibly today, daring them to hold a formal impeachment vote on the floor of the house if they want to receive any cooperation in the matter.

This matters because to this point all the Deep State Dems and their corrupt media toadies have been doing is staging their own version of a reality TV show. Instead of “Keeping Up With The Kardashians,” we should call it “Keeping Up With The Treasonists.”

Pelosi has thus far refused to hold a formal vote on the floor because the fake “impeachment inquiry” process she has constructed allows her to fully control every move. As it stands today, the GOP majority is being denied rights that have been traditionally allowed under House rules that govern impeachment inquiries that involve presidents.

Rather than try to describe the details myself, I thought it best to let some actual experts do that for you.

First, former U.S. attorney Joe diGenova and his wife, Victoria Toensing described the issues quite succinctly in an appearance with Fox Business host Lou Dobbs yesterday:

Digenova: Well, it’s quite obvious what the Democrats are doing. They have not had a vote on the floor of the house to start a formal impeachment inquiry because if they were to have such a vote, under the house rules for impeachment, the Republicans would get subpoena power. So in order to avoid giving the Republicans subpoena power, they are doing this ‘impeachment lite’ with these six different committees who are claiming it’s an impeachment inquiry, and they’re trying to subpoena people and get documents without having an impeachment vote on the floor. That is why the White House said we are not going to cooperate with this kangaroo court.

Dobbs: All right, your legal opinion: Will Trump be able to maintain that position if Pelosi does not relent?

Digenova: Yes, and in fact, the White House position is very well-founded based on the history of impeachment proceedings against presidents. Not judges – impeachment proceedings for judges are irrelevant. In terms of impeachment proceedings for presidents, always there has been a vote on the floor of the house and the minority has been given subpoena power.

Toensing: And the constitutional basis for that, Lou, is the congress is supposed to be the legislative body. Well, they’re not legislating when they’re impeaching, so they become a different kind of entity. And in that, they have to have the full support of the majority of the body. This is legal chess, and the White House just moved its queen.

Digenova: And remember what they’re trying to do: They’re trying to nullify an election.

Dobbs: They’re trying to overthrow a president.

Digenova: Exactly, and this is basically a coup in the form of an ‘informal’ impeachment inquiry. So, this is extra-constitutional as well as un-constitutional.

Former federal prosecutor Andrew McCarthy, writing at The Hill, has this to say about it in a terrific piece this morning that everyone should go read:

There is no impeachment inquiry. There are no subpoenas.

You are not to be faulted if you think a formal inquest is under way and that legal process has been issued. The misimpression is completely understandable if you have been taking in media coverage — in particular, reporting on a haughty Sept. 27 letter from House Democrats, presuming to direct Secretary of State Mike Pompeo, on pain of citation for obstruction, to cooperate in their demands to depose State Department officials and review various records.

The letter is signed by not one but three committee chairmen. Remember your elementary math, though: Zero is still zero even when multiplied by three.

What is portrayed as an “impeachment inquiry” is actually just a made-for-cable-TV political soap opera. The House of Representatives is not conducting a formal impeachment inquiry. To the contrary, congressional Democrats are conducting the 2020 political campaign.

The House has not voted as a body to authorize an impeachment inquiry. What we have are partisan theatrics, proceeding under the ipse dixit of Speaker Nancy Pelosi (D-Calif.). It raises the profile, but not the legitimacy, of the same “impeachment inquiry” House Judiciary Committee Chairman Jerrold Nadler (D-N.Y.) previously tried to abracadabra into being without a committee vote.

Moreover, there are no subpoenas. As Secretary Pompeo observed in his fittingly tart response on Tuesday, what the committee chairmen issued was merely a letter. Its huffing and puffing notwithstanding, the letter is nothing more than an informal request for voluntary cooperation. Legally, it has no compulsive power. If anything, it is rife with legal deficiencies.

So, to sum up:

  • This is not a real impeachment inquiry;
  • The Democrats, with help from the Intelligence Community and the corrupt news media, are in the midst of another coup d’etat attempt;
  • The Republicans in the House are being denied their rights under House rules; and
  • Neither the President nor any other member of the executive branch of government has any obligation to comply with any requests or subpoenas that come out of this reality TV show process.

Pelosi is dead set on denying the Republicans any right to issue subpoenas or take part in the questioning of witnesses because she knows if they get those rights, her false impeachment narrative will crash and burn.

Sure is going to be fun to watch how she responds to the White House letter.
