A Tale of Two Court Decisions: One Legitimate, One Not

Today’s Campaign Update, Part II

The increasingly unreliable Bret Baier led off his evening news report on Monday with a breathless report on a just-released decision issued by a Washington-based federal judge that would, if upheld on appeal, legitimize the Democrats’ fake impeachment process in the House of Representatives and force White House counsel Don McGhan to testify before Bug-eyes Schiff’s clown show committee.

Every corrupt “news” outlet in the fake media establishment followed Baier’s report with breathless reports of their own, all containing headlines or opening statements with some variation of “Judge says McGhan MUST TESTIFY.” The only trouble with those headlines is that is not at all the likely outcome of that case.

You have to read all the way down to the 8th paragraph of the report by Politico which I linked above to discover that the Department of Justice immediately announced it would appeal this ruling, a fact that should be the lead on these stories since the judge in this case – Ketanji Brown Jackson – is just another Obama appointee who has issued just another clearly unconstitutional decision.

Her decision will almost certainly be overturned by the appellate court, and if it isn’t, it will definitely be overturned by the U.S. Supreme Court early next year. This is because the effort by Democrats to force the President’s immediate advisors to testify is a clear and unambiguous effort to pierce the veil of executive privilege, a blatant violation of the separation of powers between the two branches of government.

The chances of McGhan ever testifying before Schiff’s clown show lie somewhere between slim and none, and Slim just rode out of town.

But there was a second, truly legitimate decision issued minutes after Jackson’s Obama fraud decision, one that is favorable to President Donald Trump (I still never tire of typing those three glorious words). As reported by Axios: [emphasis added]

The Supreme Court on Monday granted an emergency stay blocking Congress from enforcing a subpoena for President Trump’s financial records, which a lower court had upheld in October.

Why it matters: The court didn’t explain its reasoning, but the decision makes it likely that it will take up the case. For now, Trump’s longtime accounting firm Mazars USA will not be forced to turn over Trump’s tax returns to House Democrats investigating the president.

  • The justices are giving Trump’s lawyers until Dec. 5 to formally file its appeal of the lower court ruling.
  • Trump is also seeking to have the Supreme Court block a subpoena from the Manhattan district attorney’s office, which is investigating hush-money payments that the Trump Organization made to Stormy Daniels in 2016.

Between the lines: A Supreme Court ruling on the case would likely not come until mid-January, AP notes. If House Democrats are planning to vote to impeach Trump by the end of the year, as they have signaled, the tax return investigation will likely not play a role.

As Attorney General William Barr laid out in his glorious speech last week, these subpoenas are nothing but a clear case of unbridled harassment of an executive by Democrats in congress and his former home state of New York. They have no legitimate basis in the constitution or the law, and if the courts legimize the corrupt intent behind them, they will have legitimized open congressional warfare to be conducted against every future president of either party into perpetuity.

This case is a big deal for the country’s future. Pay attention to it.

Trump’s Tax Returns Show the Mark of a Great Businessman

Hey, y’all, Donald Trump lost a lot of money in the 1980s! – That’s the big “bomb” the news-fakers at the New York Times dropped on President Donald Trump Tuesday night, as the paper somehow got hold of a decade of Trump’s tax returns. In all, the returns show that Trump’s real estate and casino businesses lost over a billion dollars during the 10-year period.

Well, for tax purposes, that is. Anyone familiar with how the tax code works, i.e., nobody who works for the NYTimes, would know that tax losses do not necessarily reflect actual business losses.  The President himself addressed this idiotic move by the Times on his Twitter account this morning:

As a businessman, Donald Trump has stated repeatedly and unfailingly anytime this stupid subject has been raised by our craven fake media that he took full advantage of the U.S. tax code in the conduct of his business ventures. The demented nutjobs at the NYTimes – whose own business, by the way, also takes full advantage of the U.S. tax code – wants you to think that this means Trump is somehow a really bad guy who was stealing from you personally.

But you know what this really makes Trump? A smart businessman.

Here’s why: Tax “write-offs” exist in the code for a reason. They exist because at some point in time the U.S. congress felt it would be advantageous to the U.S. economy to incentivize certain behaviors in the business world.

Anyone with any understanding of the history of the 1980s – which again would obviously exclude anyone working for the despicable NYTimes – would know that Ronald Reagan came into office in 1981 in the midst of a major recession created by Jimmy Carter and convinced congress to pass a major tax reform designed to boost economic growth.

The new tax code (which I understand because I was an accountant doing tax work in the 1980s) that came out of that reform effort included various incentives, like the old ACRS system of accelerated depreciation, designed to increase investment of new capital in the building and manufacturing of hard assets. You know, stuff like high rise office buildings and fancy high-rise condo developments in oh, say, Manhattan.

Like me, many of my readers live in Texas. Those of us over the age of, say, 50 will remember that the skylines of Houston and Dallas were completely transformed during the 1980s, with new high-rise buildings like the ones Donald Trump was building and buying and selling in Manhattan also being built in those Texas cities by major developers like Trammel Crow.

See, building big buildings like that and manufacturing all manner of hard goods benefits the economy by creating … wait for it, Democrats because I know you don’t know the answer here … JOBS. Oh, and that other thing all Democrats hate with a passion, ECONOMIC GROWTH.

How did that new tax code work out for America? Well – listen closely all you economic ignoramuses in the Democrat Party and the fake news media – it created the LONGEST AND BIGGEST ECONOMIC EXPANSION IN MODERN HISTORY.

Oh, hey, guess which individual’s business empire was in a better position than anyone else in America in 1981 to take full advantage of the incentives offered by this handy new tax code?

That would be a guy named Donald John Trump.

And that’s really all there is to know about this particular stupid non-story.

The Democrats are Ready to “MAVA” – Make America Venezuela Again

How stupid are Democrat voters? – Impossibly stupid, apparently. With a textbook socialism-caused collapse of a formerly prosperous nation taking place right here in our own hemisphere for all to see, the Democrat voter base here in the U.S. appears intent upon taking our own country down that same doomed-to-fail path.

It isn’t just the elevation of mindless nitwits like Alexandria Ocasio-Cortez to congress, nor is the movement to self-destruction limited to support for an array of socialist presidential candidates, from Pete Buttigeig to Kamala Harris to The Commie. Democrat voters are also electing socialist thugs at the local level.

The latest example comes in Chicago, where, after the holding of this week’s runoff elections, the city council will now be home to as many as six new socialist aldermen. One of those winning socialists, a thug (because all socialists are thugs by their very nature) named Andre Vasquez, looked at the supporters assembled at his victory celebration Tuesday night and exclaimed, “Take a look around the room, we did this!”

That’s pretty much what Hugo Chavez said when he was first elected el Presidente in Venezuela in 1998. At that time, that country was a thriving, vibrant country blessed with incredible, growing wealth from its gigantic oil reserves. Today, just 21 years later, its residents are starving and dipping their buckets into sewers for drinking water.

Good luck with that, Chicago!

Speaking of thug politicians… – Chuck Schumer’s tireless efforts to prevent the proper staffing of the Trump Administration are going to become a lot harder to carry out now that Mitch McConnell and the GOP Senate majority went all nuclear upside his head on Wednesday.

The move by Republicans will result in the application of limited debate time for district judge appointments and sub-cabinet-level officials nominated by President Trump. Democrat thugs have used the pre-existing rule that allowed for them to tie up the senate for 30 hours of floor time on each nominee to prevent the Trump Administration from becoming properly staffed, and to build a huge and growing backlog of district court openings that now numbers 130.

Schumer, who, while serving as Senate Majority whip under Harry Reid, aggressively worked to enact Reid’s first “nuclear option” move when the Dems still had the majority in 2013, naturally took to the floor with a hypocritical screed against McConnell’s move, saying at one point that he was “so sorry that my Republican colleagues have gone along with Sen. McConnell’s debasement of the Senate.”

Honestly, how do these Democrats sleep at night? That’s actually a serious question.

And speaking of thug Democrats… – meanwhile, over in the House of Representatives, Democrat thugs were throwing out subpoenas like mardi gras revelers in New Orleans throw out cheap strands of beads. And these subpoenas are roughly equal in value, come to think of it.

The House Judiciary Committee, chaired by the despicable Jabba the Nadler, voted along party lines to authorize the corpulent Chairman to issue subpoenas for the “full Mueller report” in unredacted form, along with its supporting documents. They won’t get it, because such a subpoena would require Attorney General William Barr to break a multitude of federal laws.

The main concern is that federal law has always prevented the public release of grand jury material, and the Mueller report is chock-full of such material. Nadler and Bug-eyed Adam Schiff went on TV to promise they would never, never, ever allow such damaging material to be leaked, but we all know that that promise would last for about 30 seconds before it all started appearing in the New York Times and Washington Post.

So, that cat won’t flush, and the Democrats know it. They’re just doing this to keep the whole “Russia Collusion” fantasy alive through November, 2020.

Next, the House Ways and Means Committee, chaired by Massachusetts Democrat Richard Neal, threw out a demand to the IRS for all of President Trump’s tax returns for 2013 through 2018. That also ain’t gonna happen, and the Democrats know it – it’s just another effort to keep that particular sham alive through the 2020 elections.

Kevin Brady of Texas, who chaired Ways and Means in 2017-18, slammed the Democrats’ grotesque lurch into political thuggery: “This particular request is an abuse of the tax-writing committees’ statutory authority, and violates the intent and safeguards of Section 6103 of the Internal Revenue Code as Congress intended.”

That’s all true, but the Democrat Party as a whole no longer cares about such things. All they care about is the acquisition and maintenance of political power, patiently working towards the day when they once again control all levers of federal power as they did in 2009-10, during which they succeeded in nationalizing and destroying our nation’s health insurance system.

Should they ever achieve that goal again, this even more radicalized socialist Democrat Party will make 2009-10 seem like a walk in the park. They’re ready now to go full Nicolas Maduro on us, make no mistake about it.

I used to tell friends ‘vote for Democrats at your own risk,’ but I can’t even go there anymore. Because these days, a vote for any Democrat is a risk to all of us.
