Crazy Uncle Joe Sucks the Air Out of the Democrat Room in 3 New Polls

How weak is the 20-person Democrat field? – It’s so weak that a 76 year-old, miserable two-time loser in presidential politics who has been wrong about literally every major issue facing this nation over the last half-century is sucking all the air out of the room. That’s weak.

Three new polls released yesterday show Biden blowing away the rest of the Democrat field and getting close to eating up half the support among the Party’s mind-numbed voter base: He comes in at 44% support in the Harvard-Harris poll , 46% in the Hill-HarrisX online poll and 40% in the new poll from Morning Consult. The Commie lags far behind in 2nd place with just 14% support in both of the first two polls, and a little stronger 19% in Morning Consult. None of the 18 other candidates registers even in double digits in any of the polls.

That’s how weak the 20-person Democrat field is.  Yikes.

Now, these are just three polls and as I pointed out in yesterday’s Campaign Update, Biden was always destined to have some really good polling numbers coming out of the gate in his carefully-scripted campaign launch. He is a two-term vice president, a guy who spent more than 30 years in the U.S. Senate, and the most known quantity out of all of the candidates in the field. He had lead the polls consistently before he even declared his candidacy, and that lead was inevitably going to grow once he finally jumped in. So that was all a given.

But, as unreliable as we all know that political polls are these days, there is no denying that a) three polls with fairly consistent results represents something of a trend, and b) some of the numbers posted by the other, supposedly “major” candidates in this race are stunningly weak.

The best example is the numbers put up by former darling of the fake news media, Irish Bob O’Rourke, who registers at 3, 3, and 5 in these polls, respectively, despite his very strong, if fading, fundraising numbers. It turns out that even mindless Democrat base voters want something more from a candidate – even one who just 3 months ago was touted by our fake news media as the “next Kennedy” – than jumping up on tables, waving arms and spouting meaningless platitudes.  Go figure.

But what about the wymyn-folks? Well, the Party’s two most prominent wymyn, Faucahontas and Willie Brown’s Paramour, are doing better than Irish Bob, but that’s not saying much given that you can triple his numbers and still be mired in single-digits. The Fake Indian is averaging just 6.7% in these three polls, while Kamala Harris, who many “experts” were touting as the most likely Party nominee as recently as March, is doing a little better with an average of 7.3%.

But hey, at least they’re both out-pacing Irish Bob, and looky here – they’re both doing better than the fake news media’s latest Prom Date, Mayor Pete! Pete Buttigieg registers at 2, 8, and 6 in these three polls, for a not-very-impressive average of just 5.3%, despite having received hundreds of millions of dollars worth of fawning, free media coverage over the past two months.

Who else is even worth mentioning here? Well, there’s the “other” African American candidate, Cory Booker, who all the smart people in D.C. and the fake media were telling us last year might become the “next Barack Obama”, God help us. But that was all before his “I am Spartacus” moment in the Kavanaugh hearings last October. In these three polls, Sen. Spartacus comes in at 3, 3, and 3. Hey, at least he’s consistent.

Amy Klobuchar, who registers at 2, 0, and 2 is the only other candidate who even manages to come in at above 1% support in any of these polls. Kirsten Gillibrand’s candidacy is such a joke that the folks at RealClearPolitics have stopped even listing her in their average of polls table.  My goodness.

Now, some observations:

  • First, the field is very crowded right now and that means that support is scattered among the competing candidates. As the field narrows, voters will consolidate their support among those who remain in the race.
  • There is no doubt, for example, that the other Commies in the race, like Fauxcahontas and Mayor Pete, are sucking support away from the real Commie, Bernie Sanders. The problem the Commie is going to have is that Mayor Pete, as the only openly gay candidate in the race, is likely to have some real staying power in the race, since the media will be afraid to report anything negative about him.
  • Fauxcahontas is also likely to have some staying power, since she is the most shameless liar in this liar-filled field. We all know how mindless Democrat base voters love to be lied to. So the Commie is in real trouble here.
  • Kamala Harris needs to do something, anything to set herself apart from the crowd, but her main problem is that she is a terrible campaigner and a singularly dislikeable individual. As a person who literally got ahead by sleeping with a powerful benefactor, her backstory is very unappealing, and her off-putting personality doesn’t help anything.
  • I still think Andrew Yang will have his moment in the sun in this race. Once the debates begin – and he’s already raised enough money to be on the stage – he will stand out from the rest of this moribund, unappealing field because he is so much more intelligent than any of his opponents.
  • Everybody else who is currently in this race is wasting their time and money, even those who, like Irish Bob, believe they might make an appealing running mate for either of the two near-octogenarians at the top of the polls. Biden’s already focused on Georgia gubernatorial loser Stacey Abrams – who apparently feels she’s entitled  to the slot – and any other potential nominee is more likely to look outside of a bunch of just-defeated candidates for their running mate.

Again, I continue to believe that this week is the best polling week Biden will have in this race and that someone else will ultimately be the Democrat nominee. But at this point, given the amazing weakness of the rest of the field, I wouldn’t hazard a guess who that eventual nominee might be.

Honestly, I don’t really care. President Donald Trump will wipe the floor with any of these weak sisters, brothers and who-knows-what.

Despicable Dems Setting the Stage for Rejecting the 2020 Election Results

Seriously, all these people do is devise plots to defraud the American people. – Imagine, just imagine, what our country could accomplish if Democrats in Washington, D.C. spent half as much energy trying to do the right thing for the American people as they do plotting to destroy our country’s foundations each and every day.

Here is the full Democrat Party agenda as of May 6, 2019:

  • Destroy the President of the United States and do everything they can to obstruct his ability to run his administration;
  • Smear the Attorney General of the United States; and
  • Declare every election they lose to be illegitimate.

That third leg of the Democrat Party’s three-legged stool is what both the Pantsuit Princess and San Fran Nan were busy working on over the weekend. At a sparsely-attended “Evening with the Clintons” event in Las Vegas Saturday – for which ticket prices collapsed to as low as $2 – the Fainting Felon told the mind-numbed audience that the 2016 election was “stolen” from her, even though she ran “the best campaign.”

“You can run the best campaign, you can even become the nominee, and you can have the election stolen from you,” she said. Mind you, this would be the “best campaign” in which she failed to visit the normally-reliable Democrat state of Wisconsin, which voted for Donald Trump. As the Mueller Witch Hunt report clearly states, nothing was “stolen” from the Hacking Hag, not by Trump, not by the Russians, not by anyone else. But every day is Opposite Day when it comes to anyone named Clinton and objective truth.

San Fran Nan, meanwhile, was doing even heavier spade work than the Coughing Crook, telling the news-fakers at the New York Times that “If we win by four seats, by a thousand votes each, he’s not going to respect the election. He would poison the public mind. He would challenge each of the races. He would say you can’t seat these people. “We have to inoculate against that, we have to be prepared for that.”

Of course, poisoning the public mind is the very core of the Democrat Party agenda right now; thus, this is yet another clear example of the Democrats deploying the Saul Alinsky “projection” tactic, in which you accuse your opponent of the very thing you yourself are guilty of doing.

The fact is, it is the Democrats who refuse to accept the results of pretty much any election they lose. That’s why you have the spectacle of Stacey Abrams, who lost the Georgia gubernatorial race by more than 55,000 votes, still running around the country claiming to be the “rightful winner.”

I hesitate to say it, but this “refusal to accept a loss” pathology appears to be especially prevalent among Democrat women. In addition to the three we’ve already pointed out here, you had Kamala Harris saying this on Sunday:

“Let’s say this loud and clear: Without voter suppression, Stacey Abrams would be the governor of Georgia; Andrew Gillum is the governor of Florida,” the 2020 hopeful said during her keynote speech at the NAACP Freedom Fund dinner on Sunday.

That of course is a damnable lie, but damnable lies are the currency of today’s Democrat Party.

So understand what is happening here: The Democrats expect to lose the presidential election in 2020, and they are already developing a rationale for refusing to accept that looming defeat, just as the Pantsuit Princess and her party have refused for the last 31 months to accept the defeat in 2016.

The plan is set, the talking points are out, and the highest-profile women in the Democrat Party are using them to begin conditioning the public.

Because, Democrats.

Joe Biden Fumbles Through the Democrat Playbook in South Carolina

Another day, another half-filled high school gym. – When President Donald Trump (I never tire of typing those three glorious words) goes to a state, any state, to hold a rally, his advance people book the largest local enclosed arena, and he ends up speaking to a packed house of thousands with thousands more standing outside, watching on huge video screens.

When Joe Biden, the runaway leader in Democrat presidential nomination polls, goes to a state, any state, to hold a rally, his advance people ask the friendliest local high school principal to hold open his gymnasium for free, force as many of his kids as possible to be in attendance, and the candidate ends up speaking to a crowd of dozens. Don’t believe me? Here’s Creepy Uncle Joe coming into his South Carolina rally on Saturday:

Note to the intern who runs the Biden Twitter feed:  You’d be a lot better off hiding embarrassing video clips like that one. But please, ignore that advice, because this is fun.

Lots of stuff going on with the Biden campaign, most of it highly predicable, given the age and nature and party of the candidate. The most predictable part is that he’s basing his campaign on the standard Democrat playbook, which is lying and scaring people: Scaring the old folks, scaring the young folks, scaring black folks, scaring the gay folks – scare as many people as you can, because that’s the only way you can convince anybody to vote for a Democrat.

Hell, Biden’s even resorting to scaring working folks, because pretty much everybody is working these days thanks to Trump’s economy. His appeal to working folks is to say, yeah, you’ve got a job, but how is your boss treating you? Like some Democrat president is going to come into office and police all the bosses to be nicer to their employees, or something. It would be hilarious if you didn’t know that, deep down in his heart, he’s actually being serious.

Down in South Carolina, he did what Democrats always do first in that state, which is scare the Black folks. That’s like on Page 3 of the Democrat primary playbook, right after scaring the farmers in Iowa and scaring the communists in New Hampshire.

On Saturday, Biden told that high school gymnasium half-filled with mostly black folks that “You’ve got Jim Crow sneaking back in,” referring to the era of “separate but equal laws that held sway in much of the South prior to the civil rights movement of the ’50s and ’60s. It’s a damnable lie, but hey, he is a Democrat. This is what Democrats do.

A few hours later, speaking to a sparsely-attended fundraising dinner, the 76 year-old Biden slurred his words and referred to the current Prime Minister of Great Britain as “Margaret Thatcher.” Lady Thatcher, of course, left that office in 1990 and passed away in 2013. Biden’s been slurring his words at all of his campaign events, an issue that can be hidden by a friendly fake news media for awhile, but which will become starkly obvious once the televised debates begin.

Perhaps all of this explains why we continue to see more and more reporters complaining about being bullied by Biden’s staff, who are working very hard to prevent their frail, elderly candidate from having to actually answer a few questions from the press. Here’s an example from one of the complaining reporters:

The woman with the pony tail in that video is becoming infamous among the press corps, as she pushes and shoves reporters at every Biden stop to ensure they can’t get close enough for him to hear their questions.

We’ve been through all of this with a frail Democrat candidate before, of course, as we witnessed the Pantsuit Princess’s staff abusing the press corps throughout the 2016 campaign. At one point, the Fainting Felon’s staffers literally strung a rope around the press gaggle to hold them away from their sickly candidate; at another event, they actually locked one reporter in a broom closet to keep him from shouting uncomfortable questions.

Of course, you couldn’t blame them: The Grasping Grifter had all manner of health issues going on and she hasn’t uttered a public word in forty years that wasn’t written for her by someone else. She could never be trusted to take extemporaneous questions in the way President Trump does on an almost daily basis.

The same holds true for Biden. Even as a younger man, Biden was a gaffe-prone circus clown – you literally never knew what might come out of his mouth at any given time. Now that he’s older and his mind is obviously slowing down pretty rapidly (no shame in that – it happens to all of us) he cannot be trusted by his own staff to to field off-the-cuff questions from the press corps.

Biden is simply too old for this job. He just is. Again, there is no shame in that – I have nothing against elderly people and aspire to become one myself in the not-too-distant future. But our country simply cannot afford to have a frail, elderly man whose mind is obviously slipping occupying the Oval Office for four long years.

Biden had his window of opportunity four years ago, when he was still fairly cogent, to seek this office and passed it up under pressure from the Coughing Crook and Barack Obama. That window is now closed, though he hasn’t figured that out quite yet. But as the excitement over his long-delayed entry into this race fades, and the fake news media goes back to keeping its prom dates with Mayor Pete and Kamala Harris, the Democrat voter base will figure it out for him.

Joe Biden’s already had his best polling days in this race. It’s all downhill from here.

SPOTLIGHT: Another Week of Major Spygate Revelations

Today’s Campaign Update, Part II

This past week was the second straight during which multiple major new revelations about “Spygate” – the Obama Administration’s effort to fix the 2016 election and subsequent plot to execute a coup d’etat on a sitting POTUS – came to public light.  You can find last week’s review at this link. Here follows a review of what we learned during the course of this week.

First, Maria Bartiromo interviewed George Papadopoulous – one of the main targets of the FBI/CIA’s entrapment efforts against Trump officials – on her Sunday morning program, along with Devin Nunes. Here’s a clip of the full episode, in which Papadopoulous details multiple efforts by U.S. agencies to entrap him into some criminal act or admission, and in which Nunes details his suspicion that at least one spy deployed by the FBI/CIA also works as an operative for Russian intelligence.:

Next up, Attorney General William Barr acknowledged again his ongoing investigation into the real origins of the Obama spying operations, and how high the conspiracy went within the Obama Administration.:

Later on Wednesday, the reliable news-fakers at the New York Times did their best to set a favorable narrative to Spygate on behalf of the Deep State, but really only succeeded in confirming that it the FBI was spying on the Trump Campaign throughout 2016, using multiple operatives.:

I missed this when it was published on Friday, but National Review obtained a copy of the recent congressional testimony by FBI Deputy Assistant Director of Counterintelligence Jonathan Moffa, and it is extremely revelatory. Moffa’s testimony makes it crystal clear that the FBI was coordinating with the CIA during 2016, and he admits that  their spying operation ran multiple different operatives at Papadopoulous and other Trump Campaign officials in their entrapment efforts.  Amazing.:

It all becomes very convoluted and confusing, because the Obama-era bad actors had so many different angles going on targeting the Trump campaign throughout 2016, and really starting in late 2015. The guys over at the Conservative Treehouse have an outstanding, detailed explanation of how it all played out at this link. 

These two paragraphs from that piece sum up the bifurcated, coordinated effort between the CIA and FBI very succinctly:

The CIA track took place between March and July 2016, and consisted of using foreign intelligence allies in Italy, the U.K and Australia to create a background illusion of Russian involvement with the Trump campaign.  This operation was based on earlier -more innocuous- contacts from various countries, weaponized and redeployed in what everyone calls “spygate”.  This track successfully culminated in Operation Crossfire Hurricane.

The FBI track was domestic-centric, albeit sub-contracted to Fusion GPS and later a former British intelligence officer, and took place between April and October 2016; also to create the illusion of Russian involvement.  This operation is best known around the Steele Dossier and FISA warrant against U.S. person Carter Page.  The FBI track continued with the Mueller investigation into 2017, 2018 and 2019.

Watch Devin Nunes Discuss his Efforts to Expose Spygate

Today’s Campaign Update, Part II

Good information here from a Hannity interview with Devin Nunes Friday evening.

For those of you who still like to read, the transcript is below, but first the big takeaways.:

  • The Nunes letter Hannity references requests DOJ provide him with all documentation collected by the Mueller Witch Hunt related to longtime U.S. intelligence asset Joseph Mifsud.
  • Per Fox News, Nunes’ letter is also addressed to “Secretary of State Mike Pompeo, Central Intelligence Agency Director Gina Haspel, National Security Agency Director Paul Nakasone and FBI Director Chris Wray. It asks them to hand over all information they have on Mifsud by May 10.”
  • Mifsud was one of the spies the FBI ran into the Trump Campaign during 2016 in its efforts to entrap George Papadopoulous and other Trump Campaign officials into committing some illegal admission or act.
  • Nunes knows already that Mifsud has also long been an asset for other western intelligence agencies, including those from Great Britain, Australia and Italy.
  • Nunes suspects that Mifsud also serves as an operative for the Russians, and believes the Mueller Witch Hunt likely collected documentation proving that’s the case.
  • As Nunes notes, if his suspicion about Mifsud is proven correct, it would be an enormous scandal for the FBI and U.S. intelligence agencies.

Just another piece of this highly-complex puzzle that could be about to fall into place.

[Here’s the transcript of the Hannity/Nunes clip. I have used the abbreviation “Papa” to avoid having to type Papadopoulous a dozen times.:]

Nunes: After the Mueller report came out, we said we were going to comb through it. One of the first things that came out was that they used a Guardian news report to claim that the Link campus was a place where Mifsud had worked. What they failed to say in that same report was that Mifsud was linked to Italian intelligence services.

So, if you’re Mueller, you don’t get to report the parts that you want to report in your story, you have to put the entire piece before the American people. He didn’t do that, so we’re calling him out. This is not how investigations are supposed to be run.

When you look into Mifsud closer, you realize he is connected with all kinds of intelligence agencies, including our own FBI. And in that letter, Sean, you’ll see there’s pictures with FBI agents at the Link campus where Professor Mifsud teaches.

So, we asked the question – and I’ll just sum it up like this – we want to know every document that these agencies have related to Mifsud. Because if he is in fact a Russian agent, this would be one of the biggest intelligence scandals not just for our agencies, but also for the Italians and the Brits and others. Because if Mifsud is a Russian agent he would know all kinds of our intelligence agents throughout the globe.

So we asked those questions, we want those documents and we are giving them a week.

Hannity: You said that this professor has all these connections to all these western intelligence agencies, and yeah, Mueller implies that he was a Russian agent, but it may be much deeper is how I’m seeing this. My question to you is do you believe that in an effort to illegally spy on the American people that it’s possible that some at the top of our intel community under Obama/Biden may have outsourced things that were illegal for them to do Americans, so that they could have our allies do the spying for them. Let me give you an example: Great Britain or Australia or maybe Italy – am I over the target here?

Nunes: I think you are, and one of the things we point out in the letter is very specific: Because the FBI, or I should say the Mueller group, claims that Papadopoulous misled them, and they were not allowed to get to Prof. Mifsud in time in order to interview him. These are the claims they make against Papa when they sentence him to prison.

What we found it, well wait a second, if this is really what happened, and if you backtrack all of this they’re basically making the claim that Mifsud is the guy who said he had emails or other information about the emails being the hands of the Russian government. If that is in fact true, they couldn’t talk to Mifsud until supposedly January, February of 2017. Well, how do they know to ask Papa all throughout 2016 whether or not he’s seen the Russian emails, or whether he knows about the Russian emails?

The only way that’s possible is that had to come from Mifsud some way, somehow.

Now, who Mifsud’s really working for I don’t know, but like everything we do, Sean, we have to be slow and patient because we have to see what is the real relationship between Mifsud and our FBI, Mifsud and our State Department?

Hannity: You specifically talk about omissions in the Mueller report and you also explain how Papa met Mifsud. We’re about to have Papa and his wife on, and the story that we now know is true – that even the NY Times has now admitted this week, the FBI was using young, pretty, flirtatious women right out of a James Bond novel, along with Stefan Halper, along with Mifsud, to set Papa up.  Is there anything I’m saying that’s wrong, and how deep did it go?

Nunes: I said this a year ago – and I and others got mocked – I’m not interested in if the Trump Campaign was spied on. That happened. That’s a fact.

I want to know how many spies, informants, whatever you want to call them, were run into the Trump Campaign.

So, look, the Times story now says 2, that’s up from 1, my guess is it’s a lot more than that. If you listen to what AG Barr said yesterday, as sophisticated as this operation was, there had to be a lot more people, sophisticated people that were involved in this operation from our own FBI.

So I still want to know how many spies were run into the Trump Campaign. I still don’t know, but we’re gonna get the answer, and we’re gonna get it out to the American people.

The Media Mounts a Final Desperate Effort to Protect Barack Obama

The fake news media is going into overdrive. – Over the last 48 hours, we have now had the three fakest fake news outlets push their toadyism on behalf of the panicking Democrats and Deep State to a new level. On Wednesday night, the New York Times put the deep state spin on the Obama FBI’s spying operations against the Trump Campaign; Thursday night saw the release of CNN’s latest fake poll, a desperate effort to prop up the flagging campaign of Irish Bob O’Rourke; and Friday afternoon, the reliable old Washington Post jumped in with an op/ed from the execrable hack Paul Waldman.

Waldman’s piece is an obvious effort to set the narrative for the deep state as Attorney General William Barr pursues his own investigations into the origins of the Obama FBI/DOJ/CIA spying operations against the Trump Campaign. The goal of this narrative is to smear Barr – who, it is now obvious, is our nation’s first real, functional attorney general concerned about the rule of law in over a decade – in an effort to render any findings he makes as illegitimate, nothing but the work of Donald Trump weaponizing the Department of Justice to go after his opponents.

It is, in other words, the ultimate case of the media/Democrat favorite tactic of Projection: The tactic of accusing your opponents of doing exactly the things you yourself are in fact guilty of having done.

This is the beginning of a desperate effort by the Democrat/media propaganda complex to provide one final layer of cover for the head honcho who actually did deploy the FBI and DOJ and CIA to attack his opponents. It’s an operation designed to protect the guy who oversaw the entire operation and actively guided it – America’s Worst Mistake, Barack Hussein Obama. For those of us who have been paying close attention to all of the information that has come out into the public domain, Obama’s fingerprints have always been all over this illegal spying operation mounted against the opposition party’s presidential campaign.

The spying on the Trump Campaign was mounted as a counterintelligence operation by the FBI, recommended first by CIA Director John Brennan, authorized by FBI Director James Comey and managed by Deputy Chief of the Counterintelligence Division Peter Strzok. As a matter of routine, the President of the United States is given weekly briefings of the FBI’s counterintelligence operations. At the very least, Obama was fully aware of everything that was going on, a reality borne out in myriad text messages between Strzok and his paramour Lisa Page.

All of this and so much more is a matter of public record already – it is not in doubt. The fake news media has done everything it can to keep the public living in blissful ignorance about it all, but more and more Americans become aware every day, and that trend will speed up massively with the release of the pending Horowitz reports and the coming declassification of all of the underlying documents by President Trump, which will also begin to take place in the coming weeks.

So Barr must be smeared – it’s the media’s only remaining shield for Obama His Own Self. And it isn’t just Barr – other key players must and will be smeared as well.

You should expect the Post or the Times to quickly begin mounting a similar smear campaign against DOJ Inspector General Michael Horowitz, since he is supposed to issue his own reports on a) the rampant Obama-era abuse of the FISA process, and b) the leaking habits of ex-FBI Director and current Teen Drama Queen James Comey in the coming weeks. Why? Because all the perceived enemies of the Deep State/Democrat Party must be smeared. Their reputations must be besmirched as a matter of protecting the media’s puppet masters.

What about Senate Judiciary Chairman Lindsey Graham? You should expect to soon see the media mounting a smear campaign against him as well, since he is promising to use his committee to mount its own investigation into the origins of the spying operation. Graham, a life-long bachelor, has long been the subject of rumors that he is a closeted gay man. Already, we are seeing despicable cretins like Rosie O’Donnell, Alec Baldwin and Chelsea Handler launching gay smears at him via their own Twitter accounts. You should expect to see the Usual Suspect media outlets – The Post, the Times, CNN, MSNBC, etc. – to soon start running stories pushing rumors about Graham, stories they would never even consider running about any Democrat.

Yes, it is despicable. Yes, it is beneath contempt. But hey, this the fake news media and Democrats we’re talking about here. You expected something else?

Dear Mr. Attorney General:

I write on behalf of the Office of the President to memorialize concerns relating to the form of the Special Counsel’s Office (“SCO”) Report (‘”SCO Report” or “Report”) and to address executive privilege issues associated with its release.

The SCO Report suffers from an extraordinary legal defect: It quite deliberately fails to comply with the requirements of governing law. Lest the Report’s release be taken as a ” precedent” or perceived as somehow legitimating the defect, I write with both the President and future Presidents in mind to make the following points clear.

I begin with the SCO’s stated conclusion on the obstruction question: The SCO concluded that the evidence “prevent[ed] [it] from conclusively determining that no criminal conduct occurred.” SCO Report v.2, p.2. But “conclusively determining that no criminal conduct occurred” was not the SCO’s assigned task, because making conclusive determinations of innocence is never the task of the federal prosecutor.

What prosecutors are supposed to do is complete an investigation and then either ask the grand jury to return an indictment or decline to charge the case. When prosecutors decline to charge, they make that decision not because they have “conclusively determin[ed] that no criminal conduct occurred,” but rather because they do not believe that the investigated conduct constitutes a crime for which all the elements can be proven to the satisfaction of a jury beyond a reasonable doubt. Prosecutors simply are not in the business of establishing innocence, any more than they are in the business of “exonerating” investigated persons. In the American justice system, innocence is presumed; there is never any need for prosecutors to ” conclusively determine” it. Nor is there any place for such a determination. Our country would be a very different (and very dangerous) place if prosecutors applied the SCO standard and citizens were obliged to prove “conclusive ly . . . that no criminal conduct occurred.”

Because they do not belong to our criminal justice vocabulary, the SCO’s inverted-proof­ standard and “exoneration” statements can be understood only as political statements, issuing from persons (federal prosecutors) who in our system of government are rightly expected never to be political in the performance of their duties. The inverted burden of proof knowingly embedded in the SCO ‘ s conclusion shows that the Special Counsel and his staff failed in their duty to act as prosecutors and only as prosecutors.

Second, and equally importantly: In closing its investigation, the SCO had only one job – to ‘·provide the Attorney General with a confidential report explaining the prosecution or declination decisions reached by the Special Counsel.’. 28 C.F.R. § 600.S(c). Yet the one thing the SCO was obligated to do is the very thing the SCO – intentionally and unapologetically ­ refused to do. The SCO made neither a prosecution decision nor a declination decision on the obstruction question. Instead, it transmitted a 182-page discussion of raw evidentiary material combined with its own inconclusive observations on the arguable legal significance of the gathered content. As a result , none of the Report’s Volume 11 complied with the obligation imposed by the governing regulation to ·’explain[] the prosecution or declination decisions reached.” Id.

The SCO instead produced a prosecutorial curiosity – part ”truth commission” report and part law school exam paper.  Far more detailed than the text of any known criminal indictment or declination memorandum, the Report is laden with factual information that has never been subjected to adversarial testing or independent analysis. That information is accompanied by  a series of inexplicably inconclusive observations (inexplicable, that is, coming from a prosecutor) concerning possible applications of law to fact. This species of public report has no basis in the relevant regulation and no precedent in the history of special/independent counsel investigations .

An investigation of the President under a regulation that clearly specifies a very particular form of closing documentation is not the place for indulging creative departures from governing law. Under general prosecutorial principles, and under the Special Counsel regulation’s specific language, prosecutors are to speak publicly through indictments or confidentially in declination memoranda. By way of justifying this departure, it has been suggested that the Report was written with the intent of providing Congress some  kind of ‘roadmap’ for congressional action.  See,e.g., Remarks of House Judiciary Committee Chairman Jerrold Nadler, 4/18 /19 (Press Conference ). 1 If that was in fact the SCO’s intention, it too serves as additional evidence of the SCO’s refusal to follow applicable law. Both the language of the regulation and its “‘legislative ” hjstory make plain that the ‘·[c]losing documentation” language was promulgated for the specific purpose of preventing the creation of this sort of final report.2 Under a constitution of separated powers, inferior Article II officers should not be in the business of creating ‘road maps” for the purpose of transmitting them to Article I committees.

With the release of the SCO Report, and despite all of the foregoing, the President has followed through on his consistent promise of transparency. He encouraged every White House staffer to cooperate fully with the SCO and, so far as we are aware, all have done so. Voluntary interviewees included the Counsel to the President, two Chiefs of Staff, the Press Secretary and numerous others. In addition, approximately 1.4 million pages of documents were provided to the SCO. This voluntary cooperation was given on the understanding (reached with the SCO) that information (i) gathered directly from the White House or White House staffers and (ii) having to do with Presidential communications, White House deliberations, law enforcement information, and perhaps other matter may be subject to a potential claim of executive privilege and, for that reason, would be treated by the SCO as presumptively privileged.  Volume II of the report contains a great deal of presumptively privileged information, largely in the form of references to, and descriptions of, White House staff interviews with the SCO. It also includes reference to presumptively privileged documentary materials.

The President is aware that, had he chosen to do so, he could have withheld such information on executive privilege grounds, basing such an assertion on the established principle that to permit release of such information might have a chilling effect on a President’s advisors, causing them to be less than fully frank in providing advice to a President. Notwithstanding his right to assert such a privilege, and with a measure of reluctance born of concern for future Presidents and their advisors, the President has in this instance elected not to assert executive privilege over any of the presumptively privileged portions of the report. As a consequence, not a single redaction in the Report was done on the advice of or at the direction of the White House.

The President therefore wants the following features of his decision to be known and understood:

  • His decision not to assert privilege is not a waiver of executive privilege for any other material or for any other purpose;
  • His decision to permit disclosure of executive-privileged portions of the report does not waive any privileges or protections for the SCO’ s underlying investigative materials such as, for example, FBI Form 302 witness interview summaries and presumptively privileged documents made available to the SCO by the White House.
  • His decision does not affect his ability as President  to  instruct  his advisors to decline to appear before congressional committees  to  answer  questions  on  these same subjects. It is one thing for a President to encourage complete cooperation and transparency in a criminal investigation  conducted  largely within the  Executive Branch; it is  something  else entirely  to allow  his advisors to  appear  before Congress, a coordinate branch of government, and answer questions relating to their communications with the President and with each other. The former course reflected the President’s recognition of the importance  of  promoting  cooperation  with  a criminal investigation. The latter course creates profound separation  of  powers concerns and- if not defended aggressively – threatens to undermine the integrity of Executive Branch deliberations. The President is determined to protect from congressional scrutiny not only the advice rendered by his own advisors, but also by advisors to future Presidents.

 

A great deal is said these days about the rule of law and the importance of legal norms. In that spirit, and mindful of the frenzied atmosphere accompanying the Report’s release, the following should not be forgotten. Government officials, with access to classified information derived from a counterintelligence investigation and from classified intelligence intercepts, engaged in a campaign of illegal leaks against the President. Many of those leaks were felonies.

They disclosed the identity of a U.S. person in violation of his civil rights; they misused intelligence for partisan political purposes; and they eroded public confidence in the integrity and impartiality of our intelligence services. The criminal investigation began with a breach of confidentiality executed by a very senior administration official who was himself an intelligence service chief.  This leak of confidential information, personally directed by the former Director of the FBI, triggered the creation of the SCO itself – precisely as he intended it to do.

Not so long ago, the idea that a law enforcement official might provide the press with confidential governmental information for the proclaimed purpose of prompting a criminal investigation of an identified individual would have troubled Americans of all political persuasions. That the head of our country’s top law enforcement agency has actually done so to the President of the United States should frighten every friend of individual liberty. Under our system of government, unelected Executive Branch officers and intelligence agency personnel are supposed to answer to the person elected by the people – the President – and not the other way around. This is not a Democratic or a Republican issue; it is a matter of having a government responsible to the people – and, again, not the other way around. In the partisan commotion surrounding the released Report, it would be well to remember that what can be done to a President can be done to any of us.

These leaks and this investigation also caused immense and continuing interference with the functioning of the Executive Branch. Our constitution makes the President the sole constitutional officer for whom the entire Nation votes, and [who] represent[s] the entire Nation both domestically and abroad.” Clinton v. Jones, 520 U.S. 681, 711 (1997) (Breyer, J., concurring). As a result, ‘·[i] nterference with a President ‘s ability to carry out his public responsibilities is constitutionally equivalent to interference with the ability of the entirety of Congress, or the Judicial Branch, to carry out its public obligations.” Id. at 713. It is inarguable that the now-resolved allegation of ·’Russian collusion” placed a cloud over the Presidency that has only begun to lift in recent weeks. The pendency of the SCO investigation plainly interfered with the President’s ability to carry out his public responsibility to serve the American people and to govern effectively. These very public and widely felt consequences flowed from, and were fueled by, improper disclosures by senior government officials with access to classified information. That this continues to go largely unremarked should worry all civil libertarians, all supporters of investigative due process, and all believers in limited and effective government under the Constitution.

I respectfully ask you to include a copy of this letter in the Department’s records relating to the SCO investigation.

Here is what all of this means:

  • President Trump is, from this point forward going to be making extensive and rightful claims of executive privilege in order to protect his employees from being ruined financially by despicable Democrats in congress who want them to appear in hearings purely for the purpose of trying to entrap them in a “perjury trap.”
  • He is also going to be making such executive privilege claims in order to protect the priorities and rights of the executive branch of government against an out-of-control house of representatives that is desperate to continue Mueller’s two year of obstructing his presidency.
  • The President is going to very shortly begin declassify broad swaths of documents that the Mueller people did everything they could to hide from the public now that Mueller’s coup attempt has run aground.
  • Many of those documents will be released either shortly before or shortly after the issuance of the upcoming Hororwitz report on FISA abuse, since they have direct bearing on that subject.
  • Barr is moving very quickly in his own investigation of the real bad actors who attempted to fix the 2016 election and execute a coup d’etat on a duly-elected POTUS.

And here is who should be most worried about Barr’s piece of this: James Comey and the others who made a habit of leaking classified information to their friends in the fake news media, and members of the press who financially benefitted from that relationship and/or provided compensation to the leakers in exchange for the information. That is what the following passage is all about:

Dying CNN Fakes up a Poll for Foundering Beto

Another day, another fake poll. – The Democrats and their media enablers have apparently decided it’s time to try to revive the moribund campaign of their former “next Kennedy”, Irish Bob O’Rourke. With the fake Hispanic’s support among Democrats mired in the mid-single digits for the last six weeks, party leaders and fake media mavens hoping their party’s primary season will produce an interesting race that doesn’t quickly boil down to a depressing slog between two near-octogenarians know that means they need their precious “Beto” up on stage waving his arms around and promising to use his office to ban everything from reliable electricity to guns to Tylenol.

So, what’s the easiest way to rev up Democrat base-voter interest in a candidate? Why, get the news-fakers over at CNN to dummy up a fake poll showing that Irish Bob is the one guy among the 20 or so circus clowns lined up to seek the nomination who can not just defeat, but wallop President Donald Trump in the 2020 general election. You betcha.

Presto! CNN has a new poll of “registered voters” this morning pretending to show that Precious Beto would beat the President in a head-to-head race by a 52-42 margin! It’s like magic, I tell ya!

Here are the fake poll’s full top-line results:

In a new poll Beto O'Rourke emerged as the most likely to take out President Donald Trump if he were to run against him in the general elections. Of six top Democratic candidates, those polled favored five of them over Trump

In addition to its obvious, blatant effort to pump up support for the Party’s fake Hispanic – hey, why do the party and its captive media continue to ignore the real Texas Hispanic in the race, Julian Castro? –  this poll is designed to serve a couple of other purposes:

  • Put a leash on the Democrats’ fake Indian, Elizabeth Warren, who amazingly has begun to show a little momentum among Democrat voters who, after all, love to be lied to; and
  • Reassure the restless among the Democrat base that the Party’s strategy of desperately trying to keep its whole “Russia Collusion” fantasy alive right through Election Day, 2020 is working.

So, just like the New York Times has done the past couple of days with their carefully-planted fake stories designed to support the Deep State narrative, when the Democrat Party poobahs need a favor, no fake news outlet is more willing to whip it out than America’s least-favorite news-flasher, despicable old CNN.

The irony here is that the Democrat Party’s “Russia Collusion” strategy obviously is failing, and the best way to tell that is by looking at CNN’s own ratings, which have crashed through the floor since the release of the Mueller Report and its revelation that there never was any “collusion” to begin with. At least, not by anyone involved in the Trump Campaign.

The fake news network’s ratings declined by an amazing 26% in April compared to March, as the fantasy it had used to attract viewers for two solid years came up a crapper. That’s an even more amazing 41% below the network’s average rating from April, 2018. If our nation’s airports stopped their mysterious practice of giving CNN a monopoly on their captive travelers, the cable network would have almost no viewers at all.

The big problem here for the Democrats is that they really don’t have anything else other than hate and division and lies to offer the American people. Those three things form the entire basis of their Party’s reason for existing today. There is no more there there. So they have no choice but to keep doubling and tripling and quadrupling down on the only things they know to do anymore.

That means that CNN, the New York Times and all the other fake media outlets in our national fake media universe are left with no choice but to double and triple and quadruple down right along with their masters.

What a sad and destructive existence these people lead.
