Saturday News Roundup: 9th Circuit Clownshow, DOJ Moves on Google, More BLM Terrorism

The 9th Circuit once again beclowns itself. – A 3 judge panel of the leftist 9th Circuit Court of Appeals proved that court to be the patron judicial saint of lost causes yet again on Friday, ruling that President Trump’s use of Pentagon funds to build the border wall is somehow unconstitutional. It isn’t.

This ruling is even more clownish than usual for the 9th Circuit, given that the Supreme Court of the United States already ruled on this same question last July. So this decision is not only wrong, it has already effectively been overturned. The circuit court judges who voted in favor of even hearing this case should be held personally responsible for reimbursing the government’s costs related to it. This is judicial malpractice, which has become an epidemic in this country over the last 3-1/2 years.

News you won’t see reported on CNN. – Readers here will know that I have repeatedly written about the need for the U.S. Department of Justice to pursue anti-trust charges against Google, Twitter, Facebook and the other big tech monopolies, who are the modern-day version of Standard Oil. During the leadup to the 2018 elections, when it had become apparent that the Democrats would likely win control of the House, I even urged President Trump to make trust-busting a major focus of his second two years in office.

Well, here we are, less than 5 months until Election Day, and it appears to the Department of Justice is finally getting around to doing something here.

From a report at Politico:

Justice Department prosecutors expect to file an antitrust lawsuit against Google in the coming months focused on the company’s dominance in online advertising and search, two individuals familiar with the discussions said Friday.

DOJ lawyers and state antitrust officials met online Friday and discussed contours of the expected complaint, according to the people, who weren’t authorized to speak on the record because the investigation is ongoing. People knowledgeable about the case had previously described litigation as likely.

The suit is expected to involve allegations that the search giant has monopolized the advertising technology market. It is also expected to include allegations that Google has taken steps to extend its monopoly over search, such as through contracts with Apple and cellphone makers who use the Android operating system that require it be the default search engine.

The people cautioned that Attorney General William Barr, who did not attend the meeting, has yet to make a final decision on whether to sue, a judgment he could make in the coming weeks. The department would also need to decide what remedy it would seek, such as trying to break up the company or placing limits on its behavior. Whether the state attorneys general would also sign on to the DOJ complaint isn’t yet determined.

It’s very late in the game, but hey, better late than never. The problem here is exactly the same we see with the John Durham investigation still sitting out there with zero people indicted: If the presidential election goes the wrong way, any investigation into Google that has failed to produce a lawsuit by November will be immediately dropped by a Biden administration and whatever corrupt hack he names as his attorney general. A case already moving through the courts would be far harder for an incoming administration to justify ending.

Why you need to stay aware of your surroundings when out in public. – It’s becoming increasingly apparent that the domestic terrorist group Black Lives Matter is now systematically having its activists assault random white people in public. We’ve all seen the video of the 93 year-old woman who was assaulted on the street in New York last week, and yesterday we have this from Michigan:

Michigan authorities have charged an 18-year-old black man for the “unprovoked,” caught-on-video assault of a white Macy’s manager, officials said.

Damire Palmer, of Mount Morris Township, faces one count of felony assault with intent to do great bodily harm less than murder for the June 26 attack on the employee inside the Flint department store. Palmer is still in the wind.

“This was an unprovoked attack on a Macy’s employee,” said Genesee County Prosecutor David Leyton in a statement. “This behavior as seen on the video is unacceptable, it is criminal, and it cannot be allowed.”

Contrary to initial claims, police and prosecutors didn’t uncover any evidence that Palmer assaulted the staffer after he’d allegedly used the N-word, officials said.

“We don’t believe any racial slur was made by the store manager,” Leyton said.

In surveillance video that prosecutors obtained from Macy’s, Palmer walks around the store then approaches the manager from behind and clocks him in the head, knocking him to the floor, officials said.

A jury of 12 men and women has found former movie mogul Harvey Weinstein guilty on two of the five potential criminal charges he faced in his New York County trial.

Weinstein has been convicted of criminal sexual assault in the first degree, based on the testimony of former Project Runway production assistant Miriam Haley, and rape in the third degree, based on the testimony of one-time aspiring actress Jessica Mann.

The verdict was announced on Monday after the jury of seven men and five women spent five days deliberating on his fate.

Weinstein was remanded into custody against the protests of his lawyers, who cited his health. He looked ashen and unstable as he was surrounded by court officers who helped escort him out of the court room.

Weinstein will be sentenced on March 11. He’s facing five to 25 years for the criminal sexual assault conviction and 18 months to four years for the third-degree rape conviction.

At a press availability following the verdict, Weinstein’s lawyers stated that they intend to file an appeal. But the overwhelming likelihood is that this beast will be spending the remainder of his sorry existence in this life in prison. Cool.

The Bloomberg-Weinstein political relationship would continue for years, and would come to include a series of high-profile public events in Manhattan, as well as a joint push for a lucrative tax break that benefited the film industry and helped draw attention to the city.

Bloomberg is one of many famous figures who have come to regret their connections to Weinstein, who has been accused by women of rape and assault and is on trial in New York.

It is a tie that is particularly sensitive for Bloomberg, who has been accused by women of overseeing a hostile work environment and has been accused of making inappropriate comments – a topic Sen. Elizabeth Warren of Massachusetts hammered him over at Wednesday’s Demoratic debate.

Once in office, Bloomberg teamed with Weinstein at events to promote New York City, his charity, and his own election efforts.

Weinstein made last-minute phone calls on behalf of Bloomberg’s 2001 election when the then-Republican took City Hall, according to press accounts at the time.

He was behind the mayor again for his reelection in 2005, when the former filmmaking powerhouse reportedly made automated phone calls to boost the billionaire’s campaign. (Bloomberg spent $85 million on that successful effort).

Weinstein helped lend Democratic credibility and Hollywood cache to the then-independent Bloomberg’s reelection, speaking at a Democrats for Bloomberg event. ‘I haven’t heard this many Democrats saying nice things about me since I was one,’ the mayor quipped at the time.

In other instances, the two teamed up in efforts meant to promote New York and the film industry, as they did in 2002 in a brash effort to lure one of Hollywood’s biggest nights – the Oscars – to Manhattan. The idea began with a Weinstein pitch to get the entire show, then morphed into an effort by Bloomberg, Weinstein, and former New York Gov. George Pataki to bring part of the annual show to the city as a tribute to its glory days.

Oh, my. No wonder Mr. Excitement chose to skip his invited townhall scheduled to have been aired tonight on CNN.

And by the way, in case you are still buying the utter BS that Mini-Mike is 5’8″, know that Harvey Weinstein is 5’9″ when he is not pretending to need that walker. Note how he towers over Bloomberg here:

Yesterday, the Los Angeles Times ran a panicked piece that carried this headline:

Trump has flipped the 9th Circuit — and some new judges are causing a ‘shock wave’

Yes, boys and girls, I swear I don’t make this stuff up.

From the LA Times piece:

When President Trump ticks off his accomplishments since taking office, he frequently mentions his aggressive makeover of a key sector of the federal judiciary — the circuit courts of appeal, where he has appointed 51 judges to lifetime jobs in three years.

In few places has the effect been felt more powerfully than in the sprawling 9th Circuit, which covers California and eight other states. Because of Trump’s success in filling vacancies, the San Francisco-based circuit, long dominated by Democratic appointees, has suddenly shifted to the right, with an even more pronounced tilt expected in the years ahead.

Trump has now named 10 judges to the 9th Circuit — more than one-third of its active judges — compared with seven appointed by President Obama over eight years.

“Trump has effectively flipped the circuit,” said 9th Circuit Judge Milan D. Smith Jr., an appointee of President George W. Bush.

Oh, and there’s this little tidbit in that piece for those of us who have wondered how things got so tilted to the far left on the 9th circuit to begin with:

The 9th Circuit court has been dominated by Democratic appointees for decades. In 1978, a federal law created 10 new judgeships on the court, allowing President Carter to fill them all. The liberal Carter appointees were followed by judges named by three Republican presidents and two Democrats.

The more you know…

That injustice took place 42 years ago, and it took President Donald Trump (I will never tire of typing those three glorious words) to correct it.

Azar) that the HHS’s regulations implementing Title X are lawful.

The age of Obama-appointed district judges scattered across the country issuing nationwide injunctions for purely partisan reasons is ending.

Trump’s Judicial Appointees are Winning for the American People

Tired of all this WINNING yet? – In case you missed it, the Dow Jones Industrial Average closed back above 27,000 on Wednesday, and is just a little more than 200 points off of its all-time highest close. Recession? What recession?

Tired of all this WINNING yet? Part II. – In advance of the resumption of U.S./China trade talks in early October, the Chinese government announced it would rescind existing tariffs on a raft of U.S. imports, including lubricants, anti-cancer drugs and some farm goods. In return, President Donald Trump announced a two-week delay in the implementation of new tariffs on about $250 billion worth of Chinese imports, scheduled to take effect on October 1. This move by China is largely seen as an indication that the government of Xi Jinping is anxious to reach a new trade agreement as China’s economy continues to suffer great damage from U.S. tariffs, while the U.S. economy just keeps steaming along.

Tired of all this WINNING yet? Part III. – In a historic milestone, the U.S. Senate on Wednesday confirmed President Trump’s 150th judicial nominee, as six district court nominees won confirmation. Mr. Trump has now appointed 2 supreme court justices, 43 appellate court judges and 105 judges to the district courts. This laser focus on appointing and confirming judges by the President and Senate Majority Leader Mitch McConnell will have positive ramifications on this society for decades to come.

Tired of all this WINNING yet? Part IV. – Nowhere are those positive impacts already being felt more directly now than in the previously out-of-control 9th Circuit Court of Appeals. Long dominated by leftist nitwits who took pride in having their decisions constantly overturned by the Supreme Court, the six new judges who Trump and McConnell have succeeded in confirming to that 29-judge body have resulted in a sudden return of occasional constitutional jurisprudence to its decision-making.

That rebalancing of the 9th Circuit bore fruit on Monday when a panel of 3 of its judges rejected the overreach of yet another Obama-appointed district court judge, Jon Tigar.

When the Trump Administration announced in July it would resume enforcing the longstanding principle that no migrant from another country can apply for asylum in the U.S. if they had failed to do so in the first safe country they entered, leftist lawyers immediately filed suit in Tigar’s court to challenge the “new” policy, which was “new” only in the sense that it reversed the Obama Administration’s refusal to enforce that piece of the law.

Tigar naturally issued a nationwide injunction designed to prevent the Trump Administration from enforcing the new policy, a tactic that has worked time and time again to delay all efforts to gain some control over our southern border.  And always in the past, the 9th Circuit had been just a rubber stamp for such heinous judicial oversteps.

Not this time. This time, the three-judge panel ruled that Tigar’s order exceeded his court’s authority, and limited his injunction to apply only to Arizona and California, which lay in the purview of the 9th Circuit. That decision came down on Tuesday, and the left went berserk, with its Lawfare lawyers requesting an emergency ruling from the Supreme Court.

Thanks largely to President Trump’s two confirmed justices, the Supremes were having none of Tigar’s BS either, and on Wednesday they ruled, in a 7-2 decision, in favor of the 9th Circuit. Thus, the Trump Administration will now be able to enforce its new policy in New Mexico and Texas, where the vast majority of Central American caravans have been arriving since late last year. Pretty much all of these Central American migrants apply for asylum in the U.S. after refusing to do so in Mexico, and pretty much none of them qualify for that privilege.

[CORRECTION: The SC decision is even better than that. I had misread two different articles on this subject. The SC actually ruled that the Administration can enforce this policy IN FULL, without restrictions, and remanded the case back to Tigar’s court, where it will be be decided on the actual merits without any injunction being in effect.]

Thus we see the main reason for electing Donald Trump in 2016 bearing major fruit. Had Hillary Clinton won that election – as all the fake conservative Never Trump nitwits wanted her to do – there would be literally zero control over that border whatsoever, and no hope of achieving any ever again.

So, if you’ve been wondering why the Democrats and their fake media toadies have focused so much time and energy on demonizing Mitch McConnell in recent months, well, wonder no more. This is what happens to anyone who helps President Trump keep on WINNING for the American people, and Mitch has been WINNING, bigly.

Your fake news media in action. –  The fake news media has been telling us for weeks now that Jamal Khashoggi, the radical Islamist “journalist” who was murdered by the Saudis in Turkey, had a green card and was a permanent U.S. resident.

Yesterday, we found out that that was a fake story made up by our fake news media in unison in order to try to increase pressure on the Trump Administration to destroy our nation’s vital relationship with Saudi Arabia over the killing:

#EnemiesOfThePeople, defined. Our fake news media have done so many despicable things to mislead the American public over the past four years, but this episode, an overt attempt to destroy an international relationship via a coordinated invention of a legend, ranks among the worst. Yes, the killing of Khashoggi was a cowardly and loathsome act, and the Trump Administration has condemned it and sanctioned those known thus far to have been responsible for carrying it out.

On the other hand, the Saudi government has become our key Middle Eastern ally in the fight against Iran-sponsored terrorism, one of the main reasons why the frequency of acts of radical Islamic terror has fallen significantly over the past two years. That fact, combined with Saudi Arabia’s historic major influence over the price of crude oil, far outweighs the killing of a Muslim Brotherhood-supporting radical who was an enemy of the Saudi state, regardless of how it was carried out, or the fact that he went to cocktail parties with radical left-wing fake journalists in the United States.

The reality is that the governments of Saudi Arabia and Israel are the the only two entities that stand between the Middle East and utter, complete chaos today. President Trump and his administration are right to resist politically-motivated calls from our fake news media, Democrats and some Republicans to destroy our relationship with one of those countries over the killing of a non-U.S. citizen/resident that no American outside of Washington, D.C. or Manhattan cares about.

Happy Thanksgiving from Today’s Campaign Update! – They say you’re supposed to think of 10 things you are thankful for each Thanksgiving, which seems like a pretty solid idea, so I try to do that every year. I have lived a very lucky life from the day I was born, and have so many things for which to be thankful that I could list 100 here and still have many more to go.  But here is my own Top Ten…

  • My wonderful wife who has somehow tolerated being with me for 37 beautiful years;
  • The best daughter and best son on earth, and their spouses who we love as our own children;
  • Two beautiful and hilarious granddaughters;
  • Football;
  • Having lived on this earth for 62 years;
  • Having had a career in which I accomplished more than I had any right to expect when it began;
  • Having been born in the United States of America in the 20th century, the most fortunate circumstance in human history;
  • Having lived my entire life in Texas;
  • The music of Sinatra, Chicago and George Strait; and
  • My badass cat Max.

Clapper Initiates Operation CYA at a Surprising Target

For those who missed it – I compiled one of my rare Evening Campaign Updates last night, and it’s worth checking out.

It’s still the 9th Circuit, folks, and it always will be. – Twitter and cable news came all abuzz Tuesday afternoon when reports began circulating that the notoriously anti-constitutional 9th Circuit Court of Appeals had issued a decision overruling a California ban on certain rifle magazines.  Conservatives were all over Twitter and Facebook proclaiming a major victory, and that the 9th Circuit had finally seen the light!

Well, no, not exactly.  This decision was issued by a 3-judge panel subset of the Circuit Court’s huge membership, and California now has the right – which it will certainly exercise – to request the case to be heard en banc, i.e., by the Court’s full leftist-friendly membership.  The judges for these 3-judge panels are picked at random, and this particular panel just happened to draw 2 of the rare 9th Circuit judges who have actually read the 2nd Amendment.

So this decision will be reversed soon, and the 9th Circuit will regain its shoddy reputation after experiencing a rare moment of constitutional clarity.  Too bad.

Fake Indian Senator want heap big wampum. – In case anyone still maintained illusions otherwise, lifelong fraud Senator Elizabeth Warren made her and her fellow Democrats’ money-grabbing intentions crystal clear in a CNBC interview yesterday.  She told the preening fake host John Harwood that Democrats intend to immediately reverse the Trump tax cuts if they gain congressional majorities this November, and suggested the top marginal income tax rate should be raised to “well above 50%.”

Hey, maybe that’s why the very wealthy (how did he become that way on a government salary?) ex-FBI Director and Current Teenage Drama Queen James Comey is having second thoughts about encouraging everyone to vote Democrat this fall.  Go figure.

California values in action! – The Democrat-dominated California state government recently de-criminalized the act of intentionally giving another person AIDS, but the City of Santa Barbara just passed an ordinance mandating jail time for any food service employee caught in the heinous act of….wait for it….oh, you gotta wait for this one…PASSING OUT PLASTIC STRAWS TO CUSTOMERS!  I swear I do not make this stuff up.

The amiable dunce issues a subtle warning. – This is one I forgot to include in yesterday’s Evening Campaign Update, in which I laid out some of the ways in which it feels like the tide is finally turning on the whole Democrat/Media invented Russia Collusion fantasy play.  My bad.

Former Obama Administration Director of National Intelligence James Clapper seems for all appearances like sort of an amiable dunce.  His interviews on TV and dishonest congressional testimonies are often amusing to watch as he fumbles around for words and contorts his very malleable face into all sorts of odd configurations as he seemingly searches for exactly the right way to mislead.

But Clapper is a spy, a longtime intelligence operative, and as such it is important to remember that a lot of that fumbling around and contorting is done for effect.  This is a very clever man who knows how to subtly – or not so subtly – engage in a CYA operation on national television.

Well, ok, it was on CNN, which counts as “national television” these days only in the sense that it seems to be on the public TVs in every airport in America 24 hours a day, but still.  In an interview Monday evening with the terminally boring and petulant Anderson Cooper, Clapper, seeing the walls beginning to close in around him with the release of the documentation for the fraudulent FISA warrants, apparently decided it was time for Operation CYA to engage in earnest.

And engage he did, in the process tossing a very recognizable individual under the proverbial bus:

“If it weren’t for President Obama we might not have done the intelligence community assessment that we did that set up a whole sequence of events which are still unfolding today, notably Special Counsel Mueller’s investigation. President Obama is responsible for that. It was he who tasked us to do that intelligence community assessment in the first place.”

Man, this guy doesn’t fool around.  Other, less bold people in his circumstances might have tried sloughing responsibility off onto, say, ex-CIA Director John Brennan or the aforementioned Teen Drama Queen, but not Clapper – Clapper goes right to the main guy, the Capo de Tutti Capi, the Big Kahuna, Barack “The One” Hussein Obama his own self.

In doing so, Clapper perhaps appropriately assumes the posture taken by all those Nazi Generals back in 1945 who told their captors “hey, we were just following orders.”

I’m not sure it’s going to work, but you almost have to admire the chutzpah.

Just another day in the truth will all come out in the end America.
