No, Mike Pence Can’t Unilaterally Stop the Electoral Vote Certification

Let’s kill this horrible rumor dead, shall we? – Listen up: Vice President Pence does not have the power to determine whether or not congress certifies the electoral vote on January 6. He just doesn’t, and no amount of disinformation spread around social media platforms is going to change that immutable fact of life. Patrick Byrne and L. Lin Wood have been spreading that utter and complete nonsense for several days now (see below).

This stuff has also been making the rounds on Facebook and other social media platforms. It is false. It is reprehensibly false, and it is having the effect of impugning Pence’s reputation and creating a potentially dangerous situation for him and his security detail when it becomes obvious on January 6th that none of this is going to happen.

I mean, think about it: If any vice president really had any such authority, would Richard Nixon have become president in 1969? What about John Kennedy in 1961? Both of those men “won” the electoral vote over sitting vice presidents (Nixon in 1960, Humphrey in 1968) by extremely narrow margins, and Kennedy did it amid (true) allegations that the mob had stolen several states for him. If any vice president really had these powers, George W. Bush would have never become president, nor would Donald Trump, for that matter. I mean, if the sitting Veep can control the outcome, why wouldn’t the Democrat Party have simply instructed Biden to do that rather than engage in 4 years of a slow-rolling coup d’etat?

Apply Occam’s Razor here, folks: The clear answer to the questions above is that no vice president actually has any such powers. Period.

Vice President Pence has one role on January 6, and that is to preside over what is almost always a pro forma, uneventful joint session of congress during which the Electoral College results will be approved, normally via a motion for unanimous consent. If one member of the House and one member of the Senate object, however, then the joint session will be dissolved and each house will hold a brief debate before casting a role call vote on the matter.

As I reported late yesterday, the latter will be the case this time, as Missouri Sen. Josh Hawley is defying the will of Mitch McConnell and planning to file an objection, along with about two dozen members of the House. The debate will be for “up to 2 hours,” after which the vote will be held. The positive is that it will force every member of both parties to certify these clearly fraudulent election results by name for posterity. The negative part is that it has no chance whatsoever of changing the outcome.

VP Pence is not going to change that outcome, either, so put that out of your minds right now. Despite the nonsense being spread by Byrne, Wood and others, he simply has no authority whatsoever to do so.

Pence will preside over the joint session, period. That is it, and his role is very restricted while doing so. He has no power to make motions, to participate in any debate that might break out or to participate in the vote. His role is so restricted on that particular day, in fact, that he doesn’t even get to perform his normal duties as President of the Senate in the very unlikely event that a tie vote on the matter should occur.

I am aware that some other “conservative” bloggers who I won’t name are spreading this nonsense in order to attract clicks as well. I could do the same thing and no doubt drive a lot of additional traffic here, but I’m not here to do that, and I’m not going to blow smoke up your skirts. Just know that when you see other websites pushing this nonsense, that is what they are there to do, and if you like being lied to, then by all means continue to click on their stuff. They will no doubt appreciate it.

That is all.

Today’s news moves at a faster pace than ever before. Whatfinger.com is the only real conservative alternative to Drudge. It’s the tool I use to help keep up with all the day’s events, and it should be your tool, too.

My Bad… I didn’t investigate the turtle wife before posting… I just went by her looks, just looks much younger. I frankly care less about them, they are corrupt to the bone and just don’t want to waste time looking into them.

A day of reckoning will over take them soon enough. For what does it profit a man that he gain the world and yet lose his soul… I completely believe that Christ who claimed to be God will do as He stated. Those that know Him and faithfully follow Him will be rewarded with a body that never tires, gets sick and will last forever and be in the physical presence of God all the time.

The alternative will be a place of great suffering, where there is darkness and gnashing of teeth. Only to face judgement day for every action and thought you’ve ever had, where you will give answer for. Those who rejected Christ will be thrown into a lake of fire that was prepared for the devil and those that followed him. Its a place where time does not exist and theres no way out.

People like the turtle, unless he repents, will find they gained much wealth here but the horrible cost will be an eternity of great suffering. I think 2021 is going to be much more intense, its a good idea to act on Gods grace, today is a good day to receive Gods gift of life.

Its a war… choose life

Jack

I suggest you research the sequence of events and outcome when Jefferson was president of the Senate. Vice President Pence is not obligated to open any envelope that he chooses not to. (And, yes, I took a course in constitutional law.

Responding to Brian and quoting him:

“Its all about protecting their chinese overlords and not making them upset. Do you think that the turtles wife, chinese and 30 some years younger, married the trurtle because he was an extraordinary warrior and dashingly handsome to boot?!?!? Do you think shes not fed intel from the turtle which in passing conversation to ‘family’ doesn’t end up in ccp circles??”

Yep, Brian it all makes sense now. However, Mitch’s wife, Elaine Chao is actually 67, so not that much younger and from Taiwan, not mainland China. They married in 1993.

According to Wikipedia, Mitch’s estimated net worth is 22.5 million on his and his wife’s combined annual salary of maybe 400 thousand, yep, nothing to see there. Mitch also served in the US Army reserve for a whopping 37 days in 1967 before being medically discharged during the height of the Vietnam War – typical chicken-hawk. More like chicken-schiff.

No doubt theirs is a political marriage, with Chao being the labor secretary under Bush the second and the transportation secretary under Trump. Could she have been foisted upon Bush and Trump in order to (let’s just say) keep McConnell appraised of the inner workings of the most recent Republican Administrations? She may be an operative for McConnell, with Mitch being able to get appropriate info to his collogues on the other side of the aisle and then to THEIR spies.

I’m still hoping for that 20-mile diameter sinkhole for DC on Jan 21, 2121.

Q-D'Etat

You may get your wish when, as Lame Cherry has stated, Biden starts a nuclear war with Russia.

Obama tried that in 2015, with the help of Yipyip Errordog of the Neo-Ottoman regime, but was prevented from making it happen. We still had patriots in the Pentagon, though they were being ousted with a steamshovel as fast as Herr Obama could remove them.

Patricat

I missed the “Occam’s razor clause” in the US Constitution.

Arthur Teel

Furthermore, since we now know and have proof that the voting machines can be hacked and votes can be changed remotely (Ga hearing), why shouldn’t the 7 state legislatures that have selected dual elector demand that their electors be chosen, rather than the Sec of States electors?

Now all of these states have more reason to suspect outright mass fraud and the evidence and proof is still coming in. If these state legislatures are allowed to audit the machines, as they’ve demanded and find more proof, they should have the elector they have chosen be selected by Pence.

If all seven states with dual electors demand that the electors they have chosen be selected due to mass voter fraud, why shouldn’t Pence choose them?

Arthur

Well I agree that it’s not going to happen, but there is precedent for a VP choosing the electors. Especially with 7 states having chosen dual electors due to election fraud. Pence could also refuse to choose any electors and as I understand, it would then go back to congress, with one vote per state.

It also states in the 12th amendment of the constitution “The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted”

Of course, this is open to interpretation. Then there is Gomert suing Pence over the electoral count act on the grounds that the legislature can’t change the constitution. It’s a long shot and of course, the corrupt courts won’t rule in favor, but there is a case to be made. Just seems like you are glossing over the details and not addressing the merits of the effort.

And I suppose if the electoral count act stands, then you are correct. And in the end, I don’t believe Pence will do anything but what the deep state instructs him to do

Roy E. Strayer, Jr.

You state your conclusion rather emphatically, without discussing the relevant paragraphs in the US Constitution. I disagree with your conclusion. The legislative act in 1887 attempts to override the Constitutional provisions and should be done by amendment – not just a piece of legislation. That illegal altering of our Constitution is at the root of what has gone wrong in this country for many decades.
Vice President Pence has the authority to set aside the “results” of the disputed elections (i.e. refuse to acknowledge either set of electors) unless the State Legislatures from said States certify the results.
Let those opposed sue in court.

Jay Whitcraft

I have a question. If the only thing that can be accomplished by the objections of at least 1 Senator and one House member would be to delay a Biden victory for 2 hours, then why is Mitch McConnell trying so hard to stop it? I would think that vote would be good for him politically because he gets to be seen as supporting Trump with no change in the outcome. Jay

Gregg

My only guess Jay is Mitch wants to protect his RINO herd by not having them forced to vote for or against Trump.

If they vote for Trump as all “Republicans” should (every Democrat would ALWAYS support a Dem president-elect with no political repercussions) then the Deep-State (their real constituents) gets upset and might target them or remove support. If they follow Mitch and voter for btfsplk or against Trump, they know in most cases they will be toast if Trump decides to highlight their anti-Trump vote.

Mitch is just trying to protect his flock of lackeys from having their true colors exposed.

BTW Dave, where are your Senators Cruz and Cornyn and my Senators Blackburn and soon to be Senator Hagerty? It will also be very interesting to see how the two Georgia Republican Senators act if either or both prevail in their Jan 5 runoffs. Regardless of GA, we have fifty (50) GOOP (spelling deliberate) senators and only ONE (1) has the gumption to declare he will show his support for the REPUBLICAN PRESIDENT.

Defund the RNC and every single slime-ball in the house and senate who fails follow Senator Hawley and support our last real president.

Make sure that the Washington insider wheeler and dealer forever loses his status as a leader. McConnell couldn’t lead me out of a burning building – he is a sad, sad joke.

Just Me

Perhaps the concern is for the role call vote providing a list of names of those who don’t vote to allow Biden to steal the election.

brian

I think Mr Blackmon pointed out, as have others, that the turtle doesn’t give a rats hiney about the citizenry. He doesn’t care if he’s seen as for or against Trump as the Presidency doesn’t really factor in with these parasites. The turtle doesn;t care if he’s majority leader and probably prefers being the minority leader, less work and just as good profits to be made.

Its all about protecting their chinese overlords and not making them upset. Do you think that the turtles wife, chinese and 30 some years younger, married the trurtle because he was an extraordinary warrior and dashingly handsome to boot?!?!? Do you think shes not fed intel from the turtle which in passing conversation to ‘family’ doesn’t end up in ccp circles??

These traitors work with the President when it suits their purpose, not yours. Its a very good reason to start a Patriots party and let the gop starve its self. Like Gregg says, stop giving the gop ANY money, don’t fund they efforts against yourself.

Its a war, know whom you are fighting against.

Rick

Could be he does not want republican senators having to actually go on record.

Sharon Campbell

Thanks for the TRUTH as always David.

Q-D'Etat

There are more deadly possibilities out there, and these are by no means based upon Intelligence (that I know of) but on strategic reasoning:

The period between January 18-20 is a time when the Chinese may strike Taiwan, if Biden is certified. The Pentagon has a number of people who would rather see us lose a war with China than allow President Trump to stay in office, and they won’t participate in Martial Law, even if it has historical precedent.

We could easily lose a war to China, because of the disruption of the change of hands. We had better be on high alert, along with our allies.

I’m not giving up on saying “President Trump” for his second term; I’m just warning of the vulnerabilities we face if a fraudulent election is allowed to continue as-is. So I’m not concerned with reports saying this-and-that by lawyers when the courts have already been corrupted and the Great Steal is in, barring other circumstances.

Fact: we have no Judiciary.
Fact: there is no “Republican Party”
Fact: Washington is under the control of the PLA/CCP

Do what you need to do, folks. I’ve got work to do where I need to go. Keep praying, and read Psalm 25, and pray it on behalf of the President and our Nation:

Psalm of David.

1To You, O LORD, I lift up my soul.
2O my God, in You I trust,
Do not let me be ashamed;
Do not let my enemies exult over me.

3Indeed, none of those who wait for You will be ashamed;
Those who deal treacherously without cause will be ashamed.

4Make me know Your ways, O LORD;
Teach me Your paths.

5Lead me in Your truth and teach me,
For You are the God of my salvation;
For You I wait all the day.

6Remember, O LORD, Your compassion and Your lovingkindnesses,
For they have been from of old.

7Do not remember the sins of my youth or my transgressions;
According to Your lovingkindness remember me,
For Your goodness’ sake, O LORD.

8Good and upright is the LORD;
Therefore He instructs sinners in the way.

9He leads the humble in justice,
And He teaches the humble His way.

10All the paths of the LORD are lovingkindness and truth
To those who keep His covenant and His testimonies.

11For Your name’s sake, O LORD,
Pardon my iniquity, for it is great.

12Who is the man who fears the LORD?
He will instruct him in the way he should choose.

13His soul will abide in prosperity,
And his descendants will inherit the land.

14The secret of the LORD is for those who fear Him,
And He will make them know His covenant.

15My eyes are continually toward the LORD,
For He will pluck my feet out of the net.

16Turn to me and be gracious to me,
For I am lonely and afflicted.

17The troubles of my heart are enlarged;
Bring me out of my distresses.

18Look upon my affliction and my trouble,
And forgive all my sins.

19Look upon my enemies, for they are many,
And they hate me with violent hatred.

20Guard my soul and deliver me;
Do not let me be ashamed, for I take refuge in You.

21Let integrity and uprightness preserve me,
For I wait for You.

22Redeem Israel, O God,
Out of all his troubles.
